Argentina – Change in the Deregistration Process for Foreign Workers Who Have Left the Country or Whose Assignments Have Ended

What is changing?
Effective January 2018, the National Registry of Individuals (Registro Nacional de las Personas) has announced that DNI (identification card) cancellations are no longer being enforced. Instead, in order to be fully compliant with the Argentine regulation, one must apply for a resident visa cancellation at the Office of Immigration. These processes are not subject to official norms, but the changes have been implemented based on the internal regulations of each entity.

Who will be affected?

  • All clients with an employee currently residing in Argentina whose contract is nearing completion or who has left the country upon completion of assignment.

What to expect
Going forward, assignees will no longer be required to send the original DNI documents to our Argentina office in order to proceed with the cancellation on their behalf. Previous regulation established that once the assignee has left Argentina, the original DNIs had to be returned to the National Registry of Individuals (Registro Nacional de las Personas) in order to have them cancelled and destroyed. The original DNIs will no longer be required for any future residence cancellations after the assignee has departed. New documentation is now required for a residence cancellation application. In the event that the assignee should re-enter Argentina to perform new labor activities after the residence cancellation process is completed, they will be required to apply for a new work/resident permit.

This new process would take approximately between three (3) and six (6) months to be fully implemented.
